These Terms of Service govern your use of the xxi.careers platform.

1. Scope & Phases

These Terms of Service (“Terms”) govern your use of xxi.careers™, powered by HumCap OS (the “Platform”).

They apply across three phases of product development:

  1. MVP Private Testing
    Early access for invited testers to validate functionality and design. Not a commercial release.
  2. Public Beta
    An open early-access period to test features, technology, and user experience. Access is complimentary until paid Product v1.0 plans become available.
  3. Product v1.0
    Commercial release with paid memberships (including, but not limited to, Lifetime, Bridge, and Continuity plans), plus optional add-ons such as region-specific instances.

Unless stated otherwise, these Terms apply to all phases.

By creating an account, accessing the Platform, or uploading any content, you agree to these Terms.

2. Eligibility & Accounts

4. User Content & Responsibilities

You may upload fully or partially redacted documents; the system does not need your name, address, or contact details to function.

4.2 Ownership

You retain all rights to the content you upload or create (“User Content”).

By using the Platform, you grant xxi.careers a non-exclusive, worldwide, revocable licence to:

These outputs are drafts for your personal use. We do not provide legal, financial, tax, or HR advice. You remain responsible for reviewing, editing, and validating any content before sharing it with employers or third parties.

6.2 No Employment Guarantee

Use of the Platform does not guarantee interviews, job offers, or career outcomes. Outputs are tools to help you present your experience more clearly, not promises of success.

7. Plans, Pricing & Billing (Product v1.0)

This section applies once paid plans are made available.

Payments will be processed by one or more third-party payment providers (such as Stripe). Payment details are handled by the provider and not stored by xxi.careers.

For one-off products (e.g., full career audit, region-specific add-ons), fees are typically non-recurring and non-refundable unless required by applicable consumer law.

8. Data Storage, Location & Deletion

8.1 Storage & Location

During Beta and Product v1.0, all data is processed and stored within European cloud infrastructure operated by Amazon Web Services (AWS).

Data remains under European jurisdiction. AWS may internally route encrypted data between availability zones in Europe for resilience and operation.

Data is not transferred outside Europe unless and until you explicitly select a paid plan that offers region-specific deployment in another jurisdiction.

8.2 Retention & Deletion

9. Intellectual Property

All platform code, models, schemas, designs, branding, and documentation are the exclusive property of xxi.careers™ / HumCap OS and its licensors.

Nothing in these Terms grants you any ownership interest in the Platform. You may not copy, reproduce, publicly display, or create derivative works based on the Platform (other than the personal career materials you generate using your own data).

You may reference xxi.careers in your personal materials (e.g. “Structured using xxi.careers”), but you may not suggest endorsement, partnership, or employment by xxi.careers without written permission.

10. Service Changes, Availability & Termination

We aim for high availability but do not guarantee uninterrupted or error-free service. Maintenance windows, incidents, or third-party outages may temporarily affect access.

11. Disclaimers & Limitation of Liability

To the maximum extent permitted by law:

In any case, xxi.careers’ total aggregate liability arising out of or in connection with your use of the Platform will not exceed the total fees you paid in the 12 months preceding the event giving rise to the claim (or CHF 100 if you are using the Platform for free).

Nothing in these Terms excludes liability for fraud, wilful misconduct, or any liability that cannot legally be limited.

12. Governing Law & Jurisdiction

These Terms are governed by Swiss law.

Exclusive place of jurisdiction is Zurich, Switzerland, subject to any mandatory consumer protection laws that provide you with additional rights in your home jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time.

The version and effective date at the top of this document indicate the current applicable version.
