These Terms of Service govern your use of the xxi.careers platform.

1. Scope & Phases

These Terms of Service (“Terms”) govern your use of xxi.careers™, powered by HumCap OS (the “Platform”).

They apply across three phases of product development:

MVP Private Testing
Early access for invited testers to validate functionality and design. Not a commercial release.
Public Beta
An open early-access period to test features, technology, and user experience. Access is complimentary until paid Product v1.0 plans become available.
Product v1.0
Commercial release with paid memberships (including, but not limited to, Lifetime, Bridge, and Continuity plans), plus optional add-ons such as region-specific instances.

Unless stated otherwise, these Terms apply to all phases.

By creating an account, accessing the Platform, or uploading any content, you agree to these Terms.

2. Eligibility & Accounts

2.1 Eligibility

You must:

be at least 18 years old (or the age of legal majority in your jurisdiction), and
have the capacity to enter into a binding agreement.

If you use the Platform on behalf of an organisation, you represent that you are authorised to do so, and these Terms bind that organisation.

2.2 Account Creation

To use the Platform, you must create an account, typically using your email address. The Platform may use passwordless login (e.g. one-time codes sent to your email) or comparable secure methods.

You are responsible for:

providing accurate and up-to-date information,
keeping your login details secure, and
notifying xxi.careers immediately of any suspected unauthorised access.

3. Nature of the Service

3.1 Purpose

xxi.careers is a career continuity platform. It helps you:

structure your CV / résumé content into experiences, skills, and achievements;
generate draft STAR / CAR-style stories and professional summaries;
maintain an “always-ready” professional record;
optionally export or share outputs you choose.

The Platform is not a recruitment agency, job board, or employment guarantee service.

3.2 Beta and Iteration

During MVP and Public Beta:

features may be experimental, incomplete, or subject to change without notice;
performance, availability, and output quality may vary;
data models, wording, and UI/UX may evolve based on feedback.

You acknowledge that Beta phases are primarily for testing and improvement.

4. User Content & Responsibilities

4.1 Data You Provide

You may choose to upload or enter:

CV / résumé content, work history, education, skills, and related professional details;
optional notes, reflections, or survey responses;
optional profile details (e.g. name, location, preferred role title).

Core Platform functionality does not require personally identifiable information (PII).
You may upload fully or partially redacted documents; the system does not need your name, address, or contact details to function.

4.2 Ownership

You retain all rights to the content you upload or create (“User Content”).

By using the Platform, you grant xxi.careers a non-exclusive, worldwide, revocable licence to:

store, process, and transform your User Content for the purpose of providing the services,
generate derived outputs (e.g. structured experiences, summaries, STAR stories) for your personal use,
use anonymised and aggregated data for improving models, features, and performance.

We do not sell your User Content. We do not make it available to employers or third parties without your explicit consent.

4.3 Your Responsibilities

You must not upload content that:

is unlawful, defamatory, discriminatory, or otherwise harmful;
infringes any intellectual property, privacy, or other rights of third parties;
contains malicious code, scripts, or attempts to disrupt the Platform.

You are responsible for ensuring that any data you provide (for example, about past employers or colleagues) is shared in a lawful and appropriate manner.

5. Platform Behaviour & Acceptable Use

You agree not to:

attempt to bypass security, rate limits, or access controls;
decompile, reverse-engineer, or otherwise attempt to derive source code or underlying models;
use the Platform to build, train, or enhance competing products;
resell, sublicense, or commercially exploit the outputs except as part of your personal career materials (e.g. CV, cover letters, interview preparation).

xxi.careers may suspend or terminate access if it reasonably believes you are misusing the Platform or violating these Terms.

6. AI-Generated Content & No Guarantees

6.1 Drafts, Not Final Advice

The Platform may generate:

structured experience records,
skills/capability maps,
STAR / CAR stories and summaries,
interview preparation content.

These outputs are drafts for your personal use. We do not provide legal, financial, tax, or HR advice. You remain responsible for reviewing, editing, and validating any content before sharing it with employers or third parties.

6.2 No Employment Guarantee

Use of the Platform does not guarantee interviews, job offers, or career outcomes. Outputs are tools to help you present your experience more clearly, not promises of success.

7. Plans, Pricing & Billing (Product v1.0)

This section applies once paid plans are made available.

7.1 Plans

xxi.careers may offer several plans, such as:

Continuity Plan (ongoing subscription),
Bridge Plan (time-limited),
Lifetime Plan (one-off),
optional paid add-ons, such as region-specific hosting or enhanced storage.

Exact features and pricing will be set out on the website or within the app at the time of purchase.

7.2 Payments

Payments will be processed by one or more third-party payment providers (such as Stripe). Payment details are handled by the provider and not stored by xxi.careers.

You are responsible for:

ensuring your payment method is valid and up to date,
any charges incurred through your account.

7.3 Renewals & Cancellations

For recurring plans:

subscriptions typically renew automatically at the end of each billing period;
you can cancel future renewals via in-app settings or by contacting support before the renewal date.

For one-off products (e.g., full career audit, region-specific add-ons), fees are typically non-recurring and non-refundable unless required by applicable consumer law.

8. Data Storage, Location & Deletion

8.1 Storage & Location

During Beta and Product v1.0, all data is processed and stored within European cloud infrastructure operated by Amazon Web Services (AWS).

Data remains under European jurisdiction. AWS may internally route encrypted data between availability zones in Europe for resilience and operation.

Data is not transferred outside Europe unless and until you explicitly select a paid plan that offers region-specific deployment in another jurisdiction.

8.2 Retention & Deletion

There is no automatic, time-based deletion of your account during Beta or Product v1.0.
You may delete your account or request deletion of your data at any time through in-app settings or by contacting privacy@xxi.careers.
Upon deletion, active User Content is removed from primary systems within approximately 30 days and cannot be recovered.
Minimal audit logs may be retained for a limited time (typically up to 90 days) for security and compliance.

9. Intellectual Property

All platform code, models, schemas, designs, branding, and documentation are the exclusive property of xxi.careers™ / HumCap OS and its licensors.

Nothing in these Terms grants you any ownership interest in the Platform. You may not copy, reproduce, publicly display, or create derivative works based on the Platform (other than the personal career materials you generate using your own data).

You may reference xxi.careers in your personal materials (e.g. “Structured using xxi.careers”), but you may not suggest endorsement, partnership, or employment by xxi.careers without written permission.

10. Service Changes, Availability & Termination

10.1 Changes

xxi.careers may:

add, modify, or remove features;
update underlying models or data structures;
change pricing and plan structures (with reasonable notice for paid users).

Where changes significantly affect your rights, we will provide notice via email or in-app.

10.2 Availability

We aim for high availability but do not guarantee uninterrupted or error-free service. Maintenance windows, incidents, or third-party outages may temporarily affect access.

10.3 Termination

We may suspend or terminate your access if:

you violate these Terms,
your use creates security or legal risk,
we discontinue the Platform or a particular feature.

You may stop using the Platform at any time and request deletion of your account.

11. Disclaimers & Limitation of Liability

To the maximum extent permitted by law:

The Platform is provided “as is” and “as available”, without warranties of any kind, whether express or implied.
xxi.careers does not guarantee that generated content will be accurate, complete, or suitable for any particular purpose.
xxi.careers is not liable for:
- indirect, incidental, special, punitive, or consequential damages;
- loss of profits, opportunities, or employment;
- loss of data, where reasonable backup and export options have been made available.

In any case, xxi.careers’ total aggregate liability arising out of or in connection with your use of the Platform will not exceed the total fees you paid in the 12 months preceding the event giving rise to the claim (or CHF 100 if you are using the Platform for free).

Nothing in these Terms excludes liability for fraud, wilful misconduct, or any liability that cannot legally be limited.

12. Governing Law & Jurisdiction

These Terms are governed by Swiss law.

Exclusive place of jurisdiction is Zurich, Switzerland, subject to any mandatory consumer protection laws that provide you with additional rights in your home jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time.

For material changes, we will notify you via email or prominent in-app notice.
Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

The version and effective date at the top of this document indicate the current applicable version.
